Barake Terms of Service

1. Agreement

These terms govern your use of the Barake app and of the barake.app website, both published by Orizon42. By creating a parent account, you agree to them, on your own behalf and on behalf of the children you add to Barake.

2. Who may use Barake

A parent account must be created by an adult who has reached the age of majority where they live. That adult takes responsibility for the way Barake is used on their children's phones.

A child uses Barake only on a phone that their parent has linked to the parent account. They do not create an account. By adding a child and linking their phone, the parent confirms that they are that child's parent or legal guardian, that they are entitled to manage that phone, and consents to the processing of the child's data as described in the Privacy Policy.

3. What Barake does

Barake lets a parent limit apps on their child's phone, and lets the child earn screen time and rewards:

• the parent chooses the apps to limit; they stay locked until the child trades tokens for screen time;
• the child earns tokens, called B, by doing chores the parent approves, by passing quizzes on their school curriculum, graded automatically, and with a daily bonus they can collect on days when blocking stayed on;
• the child trades their B for screen time (1 B = 1 minute), which unlocks the limited apps until that time runs out, or for a reward the parent offers in the child's shop. A daily cap, a bedtime and, if the parent chooses, the expiry of traded time at midnight apply on top.

On iPhone, Barake relies on Apple's Screen Time technology, with or without Apple Family Sharing. If the child's iPhone belongs to the parent's Family Sharing group, the child cannot remove Barake's permission or delete the app without the parent's approval; otherwise, they can remove that permission in the phone's settings, and the parent's app shows it. On Android, Barake relies on the accessibility service and usage access, which the parent turns on in the phone's settings.

4. What Barake does not do

• Barake is a tool, not a guarantee. It works within what Apple and Google allow. A system update, a setting changed on the phone, a restart or a determined child may stop blocking for a while; on Android in particular, turning off the accessibility service stops it, and the parent's app shows it. Barake does not replace a parent's attention.
• Barake does not filter content. It locks and unlocks apps; it does not read, sort or block what is shown inside them.
• B have no monetary value. They are not money: they cannot be bought, sold, cashed out or transferred to another child, and they exist only inside the account. Barake receives, holds and pays out no money between the members of an account.
• Rewards are the parent's promises. The parent alone chooses the rewards in the shop and their price in B, including a reward expressed as an amount of pocket money, and hands them over outside the app. When the parent declines a trade, or the child cancels it before an answer, the B are given back.

5. Quizzes

Each school subject the parent ticks gives the child a quiz every day. Quizzes follow the official French school curriculum, from the first year of primary school to the end of high school. We write and check them carefully, but a question or an answer may contain a mistake: tell us and we will correct it. Barake is not affiliated with the French Ministry of Education, and a quiz result is not a school grade.

Leaving the app during a question counts as a wrong answer, and a failed quiz can be tried again only after a waiting time. These rules are part of the service.

6. Your account and your child's phone

You are responsible for keeping your sign-in details and your parent code confidential, and for activity carried out from your account. Tell us promptly if you suspect unauthorized access.

A child's phone is linked with a code shown on your phone, valid for a short time, or with the child's permanent reconnection code, shown in their settings on your phone. Share these codes only with your child's phone. Logging out the child's phone requires your parent code. You can unlink a phone at any time from your own app.

7. Your content

You keep ownership of what you put in Barake — chore and reward names, notes, the photos taken on your child's phone and the reward photos you add. You grant Orizon42 only the right to host that content and display it to the members of your account, solely to operate the service.

Chore photos are meant to show a chore that was done. You agree not to use them, or any note, for anything unlawful, violent, hateful or harmful to a person's dignity, and not to use Barake to pressure, humiliate or monitor anyone beyond the limits of parental authority. We may remove clearly unlawful content and suspend the account involved.

8. Subscription and free trial

Barake can be used for free: blocking apps, chores, the daily bonus and the shop, without limit, and one school subject for each child. A subscription unlocks every school subject; one subscription covers all the children on your account.

• Free trial: where the store offers it, a new subscription starts with a 7-day free trial. Nothing is charged during the trial; the subscription then starts automatically unless you cancel at least 24 hours before the trial ends.
• Prices are shown in the app and in the App Store or Google Play before you confirm a purchase, in your local currency.
• Payments are processed by Apple or Google, depending on your device. We never receive or store your payment details.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Cancellation happens in your Apple or Google account settings, not in Barake — we have no control over those subscriptions.
• Refund requests are governed by Apple's or Google's policies.
• If pricing changes, you will be notified before renewal.

When a subscription ends, at the end of the period already paid for, Barake carries on as the free version: blocking, chores, the daily bonus, the shop and your children's B stay in place. School subjects beyond the first one for each child are paused, and come back as they were if you subscribe again. Your account and settings are not deleted.

9. Reminders and notifications

Barake sends notifications through Apple's and Google's notification services. We do our best to deliver them at the time set, but we cannot guarantee that they arrive, or arrive on time: that also depends on the phone, its settings and its network. B credited by an approval, and screen time traded for B, reach the child's phone the next time it syncs.

10. Availability

We work to keep the service available but do not guarantee uninterrupted access. Interruptions may occur for maintenance, updates, or because of a technical provider, Apple or Google included.

11. Disclaimers and liability

Barake is a parenting tool. We are not responsible for the rules you set, for the apps you choose to limit or leave open, for what a child does on their phone, for the rewards you offer or hand over, or for arrangements made between the members of your account.

To the extent permitted by law, the service is provided "as is." Our liability will not exceed the amounts you paid for the subscription in the previous twelve months. Nothing here limits liability for gross negligence, fraud, or personal injury where the law forbids such limitation, nor the rights you have as a consumer under mandatory law.

12. Termination

You may delete your account at any time, in Settings. Deletion is permanent: it erases your data and your children's as described in the Privacy Policy. You may also remove a child, which erases their B and their trades, or unlink their phone, at any time.

Deleting your account does not cancel a subscription: cancel it first in your Apple or Google account settings. Once your account is deleted, your children's phones lift every block the next time they open Barake.

We may suspend or terminate an account for a serious breach of these terms, after notifying you where possible.

13. Intellectual property

The app, the website, the Barake brand, its interface, its quizzes and its code remain the property of Orizon42. Nothing here transfers any right in them to you.

14. App Store

If you downloaded Barake from Apple's App Store, these terms are between you and Orizon42, not Apple. Apple has no obligation to provide maintenance or support for the app, and is not responsible for addressing claims relating to it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims of intellectual property infringement. If the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes

We may update these terms. For material changes, you will be notified in the app before they take effect. Continuing to use the service afterward constitutes acceptance.

16. Governing law and disputes

These terms are governed by French law. This choice does not deprive you of the protection afforded by the mandatory provisions of the law of the country where you habitually reside.

We will first try to resolve any dispute amicably: write to us using the details below. If no agreement is reached, the dispute may be brought before the competent courts, including, if you are a consumer, the courts of your place of residence.
